Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by MythX Inc. ("the Service"), you unconditionally acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service, the Privacy Policy, and any other policies referenced herein. If you do not agree, you are expressly prohibited from using the Service and must discontinue use immediately.

Your continued use of the Service confirms your agreement to adhere to both the **Discord Terms of Service** and the **Discord Developer Terms of Service**. Any violation of Discord's terms is considered a violation of these Terms.

2. Age Requirements and Eligibility

**The Service is not intended for users under the age of 13.** By using the Service, you represent and warrant that you are at least thirteen (13) years of age.

• If you are **13 years old or older but under the age of majority** in your jurisdiction (typically 18), you must have the explicit **permission of your parent or legal guardian** to use the Service, and your parent or guardian must read and agree to these Terms on your behalf.
• If we learn that we have collected personal information from a user under the age of 13 without verification of parental consent, we will take immediate steps to remove that information and terminate the associated account.

3. Discord Login & User Data

Our Service uses Discord's OAuth2 protocol for authentication. **We do not store your Discord password.** When you log in, we collect your **Discord User ID**, **Username**, **Avatar URL**, and the list of **Guilds** (servers) you are a member of. This data is used solely to provide and enhance the Service, enforce our policies, and comply with legal obligations. Detailed information is available in our Privacy Policy.

You are solely responsible for maintaining the security of your Discord account. We shall not be liable for any unauthorized access resulting from your failure to keep your credentials secure.

4. User Conduct and Restrictions

You agree to use the Service strictly in accordance with all applicable laws, Discord's Terms of Service, and Discord's Developer Terms. Prohibited activities that will result in immediate termination include, but are not limited to:

• Posting, transmitting, or uploading harassing, abusive, or offensive content.
• Attempting unauthorized access to the Service's systems, data, or source code.
• Distributing malware, viruses, or any malicious code.
• Using the bot for spamming, farming, or any disruptive activity that exceeds reasonable usage limits or circumvents rate limits.
• Reverse engineering, deconstructing, or attempting to discover the source code of the Service.
• Using the Service to promote or engage in illegal activities, including but not limited to, child pornography, or any activity prohibited by Discord.

5. License for User Content

You retain all ownership rights to the content you submit, post, or display on or through the Service ("User Content"). However, by providing User Content, you grant MythX Inc. a **worldwide, non-exclusive, royalty-free, perpetual, transferable, and sublicensable license** to use, reproduce, modify, adapt, publish, and distribute your User Content solely for the purpose of operating, improving, and developing the Service (e.g., executing commands, data analysis, logging).

You warrant that your User Content does not infringe upon the intellectual property or proprietary rights of any third party.

6. Intellectual Property

All intellectual property rights in and to the Service (including all code, visual assets, documentation, and algorithms) are the sole and exclusive property of MythX Inc. The bot is licensed, not sold, to you for non-commercial, non-transferable use.

You may not copy, modify, distribute, sell, or lease any part of our Service. Any attempt to exploit or misuse the intellectual property of MythX Inc. will result in immediate legal action and termination of service.

7. Disclaimer of Warranties (AS IS)

**THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.** To the fullest extent permissible pursuant to applicable law, MythX Inc. disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, security, and availability.

MythX Inc. does not warrant that the Service will be uninterrupted, error-free, timely, secure, or that any defects will be corrected. Your use of the Service is entirely at your sole risk and discretion.

8. Indemnification

**You agree to defend, indemnify, and hold harmless MythX Inc. and its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including, but not limited to, attorney's fees) arising from:**

• Your use of and access to the Service, including any data or content transmitted or received by you.
• Your breach of any term of these Terms of Service, including the Age Requirements.
• Your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights.
• Your violation of any applicable law, rule, or regulation, including the Discord Terms of Service.
• Any User Content posted or shared via your account.

This defense and indemnification obligation will survive the termination of these Terms and your use of the Service.

9. Limitation of Liability

**IN NO EVENT SHALL MYTHX INC., NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.**

In no case shall the total liability of MythX Inc. to you for all damages, losses, and causes of action exceed the amount, if any, paid by you for accessing the Service in the last twelve (12) months, or **fifty U.S. Dollars (USD $50.00)**, whichever is less.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms, or violate the Discord Terms of Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may cease using the Service at any time by removing the bot from your server(s).

11. Third-Party Links and Services

The Service may contain links or references to third-party websites or services (e.g., external APIs, documentation). MythX Inc. does not endorse and assumes no responsibility for any third-party sites, information, materials, products, or services. Your access and use of third-party content is at your own risk.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of **Estonia**, without regard to its conflict of law provisions.

13. Dispute Resolution and Class Action Waiver

**READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.**

Any dispute, controversy, difference, or claim arising out of or relating to these Terms, including the existence, validity, interpretation, performance, breach or termination thereof, shall be referred to and **finally resolved by binding arbitration**.

• **No Class Actions:** You and MythX Inc. agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative action. Unless both you and MythX Inc. agree otherwise, the arbitrator may not consolidate more than one person’s claims.
• **Right to Opt-Out:** You may opt-out of this arbitration agreement by sending a written notification to teammythicalbot@gmail.com within 30 days of first becoming subject to these Terms.

14. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The failure of MythX Inc. to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Force Majeure

MythX Inc. shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond MythX Inc.'s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation (e.g., "line-noise" interference), acts of God, fire, terrorism, public enemy, war, government actions, or failure of Discord's API or systems.

16. Changes to Terms

MythX Inc. reserves the sole right to update or modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. We will attempt to provide at least 30 days notice prior to any major changes taking effect, but failure to provide notice shall not invalidate the changes.

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must discontinue the use of the Service.
